## 3. Account Registration and Billing

 

### 3.1 Account Creation

To use our services, you must:

- Provide accurate and complete registration information

- Be at least 18 years old or have parental consent

- Maintain the security of your account credentials

- Promptly update any changes to your account information

 

### 3.2 Billing and Payment

- All services are billed in advance unless otherwise specified

- Payment is due upon invoice generation

- We accept major credit cards, PayPal, and other approved payment methods

- Failed payments may result in service suspension or termination

- All fees are non-refundable unless otherwise stated in our refund policy

 

### 3.3 Automatic Renewal

- Services automatically renew at the end of each billing cycle

- You will be charged the then-current rates for renewal

- You may cancel automatic renewal through your account panel

- Cancellation must be requested before the renewal date

 

## 4. Acceptable Use Policy

 

### 4.1 Prohibited Uses

You may not use our services for:

 

**Illegal Activities:**

- Any illegal activities or violation of applicable laws

- Copyright, trademark, or intellectual property infringement

- Distribution of malware, viruses, or malicious code

- Hacking, phishing, or unauthorized access attempts

 

**Harmful Content:**

- Adult content, pornography, or sexually explicit material

- Hate speech, harassment, or discriminatory content

- Content promoting violence or illegal substances

- Spam, bulk email, or unsolicited communications

 

**Resource Abuse:**

- Excessive use of server resources affecting other users

- Cryptocurrency mining or similar resource-intensive activities

- Running scripts that consume excessive CPU, memory, or bandwidth

- Storing backup files from other hosting providers

 

**Network Abuse:**

- Port scanning, vulnerability scanning, or network probing

- Running IRC bots, game servers, or proxy services (unless authorized)

- Participating in DDoS attacks or similar network disruptions

 

### 4.2 Content Responsibility

- You are solely responsible for all content stored on or transmitted through our services

- You must have proper rights and licenses for all content you upload

- We reserve the right to remove content that violates these Terms

- You agree to indemnify us against any claims related to your content

 

## 5. Service Level and Uptime

 

### 5.1 Uptime Guarantee

- We strive to maintain 99.9% uptime for shared and VPS hosting

- Uptime calculations exclude scheduled maintenance and force majeure events

- Service credits may be available for significant downtime periods

- Uptime guarantees do not apply to free or promotional accounts

 

### 5.2 Maintenance

- We perform scheduled maintenance during low-traffic hours

- Emergency maintenance may occur without prior notice

- We will attempt to provide advance notice of scheduled maintenance

 

### 5.3 Resource Limits

- Shared hosting accounts have CPU, memory, and storage limitations

- Resource usage is monitored and may be restricted if limits are exceeded

- Upgrade options are available for accounts requiring additional resources

 

## 6. Data and Privacy

 

### 6.1 Data Backup

- We perform regular backups but do not guarantee data recovery

- You are responsible for maintaining your own backups

- Backup restoration may incur additional fees

- We are not liable for any data loss

 

### 6.2 Privacy Policy

- Our collection and use of personal information is governed by our Privacy Policy

- We do not sell or share your personal information with third parties

- We may access your data only as necessary to provide services or comply with legal requirements

 

### 6.3 Data Security

- We implement industry-standard security measures

- You are responsible for securing your account credentials

- Report any suspected security breaches immediately

- We cannot guarantee absolute security of data

 

## 7. Domain Registration Terms

 

### 7.1 Domain Ownership

- Domain registration creates a license to use the domain name

- Domain ownership is subject to registry policies and ICANN regulations

- You must provide accurate WHOIS information

- False or misleading registration information may result in domain suspension

 

### 7.2 Domain Renewals

- Domains must be renewed before expiration to avoid loss

- Renewal notices are sent to the email address on file

- Expired domains may be subject to redemption fees

- We are not responsible for domains lost due to non-renewal

 

### 7.3 Domain Transfers

- Domain transfers are subject to registry transfer policies

- Transfer fees apply as specified in our pricing

- Transfers may take 5-7 days to complete

- Some domains may be locked from transfers for security reasons

 

## 8. Service Suspension and Termination

 

### 8.1 Suspension Reasons

We may suspend your services for:

- Non-payment of fees

- Violation of these Terms or Acceptable Use Policy

- Excessive resource usage affecting server performance

- Security threats or compromised accounts

- Legal requirements or court orders

 

### 8.2 Termination Process

- We will attempt to provide notice before suspension when possible

- You may cure violations within the specified timeframe

- Repeated violations may result in immediate termination

- Data may be permanently deleted after account termination

 

### 8.3 Customer Termination

- You may terminate services at any time through your account panel

- Termination does not entitle you to refunds unless specified

- Data backup and transfer assistance may be available for a fee

- Final invoices must be paid regardless of termination date

 

## 9. Refund Policy

 

### 9.1 Hosting Services

- New hosting accounts are eligible for a 30-day money-back guarantee

- Refunds apply only to hosting fees, not setup fees or add-ons

- Refund requests must be submitted within 30 days of initial signup

- Accounts terminated for Terms violations are not eligible for refunds

 

### 9.2 Domain Names

- Domain registrations and renewals are non-refundable

- Registry fees cannot be refunded once a domain is registered

- Domain privacy and other add-ons are non-refundable

 

### 9.3 Other Services

- SSL certificates, licenses, and third-party services are non-refundable

- Setup fees and migration services are non-refundable

- Refunds will be issued to the original payment method when possible

 

## 10. Limitations of Liability

 

### 10.1 Service Disclaimers

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

 

### 10.2 Limitation of Damages

IN NO EVENT SHALL Cielo Cloud Host BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATING TO THESE TERMS OR OUR SERVICES.

 

### 10.3 Maximum Liability

OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR SERVICES DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

 

## 11. Indemnification

 

You agree to indemnify, defend, and hold harmless Cielo Cloud Host, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorney fees) arising from:

- Your use of our services

- Your violation of these Terms

- Your violation of any third-party rights

- Content you submit, post, or transmit through our services

 

## 12. Intellectual Property

 

### 12.1 Our Intellectual Property

- All software, systems, and proprietary technology remain our property

- You receive a limited license to use our services

- You may not reverse engineer, modify, or distribute our software

- Our trademarks and logos may not be used without permission

 

### 12.2 Your Intellectual Property

- You retain ownership of content you upload to our services

- You grant us a license to host, store, and display your content

- You are responsible for ensuring you have rights to all uploaded content

 

## 13. Force Majeure

 

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including:

- Acts of God, natural disasters, or extreme weather

- War, terrorism, civil unrest, or government actions

- Labor strikes or disputes

- Internet outages or infrastructure failures

- Cyberattacks or security breaches affecting third-party services

 

## 14. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of Georgia, without regard to conflict of law principles.

- Disputes shall be resolved through binding arbitration
